RARO Homes is the trading name of EyeQ Business Solutions and the term Company refers to EyeQ Business Solutions for its trading name RARO HOMES, a provider for home products.

The publication of this document aligns with the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011, which mandates the publication of rules and regulations, privacy policy, and Terms of Use for access or usage of www.rarohomes.in.

(a)The domain name www.rarohomes.in, referred to as ‘the Website,’ is owned by EyeQ Business Solutions, hereinafter referred to as ‘the Company,’ with its registered branch office located at HNo 25, Sec 10, Nanak Nagar, Jammu (J&K) 180004

(b) For the purposes of these Terms of Use, where the context necessitates, ‘you’ or ‘user’ refers to any natural or legal person who has agreed to become a buyer on the Website and order goods and services available by providing registration data during the Website registration process. Engaging with the site’s services without registration does not exempt you from this contractual relationship. The term ‘RARO Homes’ or ‘we’ or ‘us’ pertains to the Company. The headings of each section in this Agreement serve the purpose of organizing the various provisions orderly. These headings are not intended for either party to interpret the provisions within them in any way. Furthermore, the headings hold no legal or contractual value.

(c) Your use of this Website is exclusively governed by this policy and any policy referenced by terms of reference. Proceeding past the home page or utilizing any of the services implies that you have read and agreed to be bound by all the policies. You are bound by the rules, guidelines, policies, terms, and conditions applicable to any service provided by this site, and they are considered incorporated into these Terms of Use.

WHO ARE WE?

We accept orders online, collect payments, and deliver the products to the user’s doorstep. Any order placed by you is subject to product availability, delivery capacity, and acceptance by RARO Homes.

1. MEMBERSHIP

The use of this Website/Application is restricted to individuals above the age of 18, excluding those ‘Incompetent to Contract,’ which, among others, includes insolvents. If you are a minor and intend to use the Website, you must do so through your legal guardian. The Website/Application reserves the right to cancel your order if it becomes aware that you are a minor and have registered on the Application or availed any of its services without a legal guardian.

2. YOUR REGISTRATION OBLIGATIONS

If you use the Website/Application, you are responsible for maintaining the confidentiality of your display name and password. You are also responsible for all activities that occur under your display name and password. You agree that if you provide any information that is untrue, inaccurate, not current, or incomplete, or if we have reasonable grounds to suspect that such information is untrue, inaccurate, not current, or incomplete, or not in accordance with these Terms of Use, we reserve the right to indefinitely suspend, terminate, or block access to your membership on the Website/Application. We may also refuse to provide you with access to the Website.

By placing an order through this Website/Application, you are required to provide RARO Homes with your email and/or mobile number, login/password. Your use of this Website/Application implies your consent to receiving calls, auto-dialed and/or pre-recorded message calls from us at any time, using the number provided by you for the use of this Website. This is subject to the Privacy Policy, including contact through information received from other parties. Your use of this website also constitutes consent to receive SMS from us at any time we deem fit. This consent includes purposes such as clarification calls, marketing, and promotional calls. If you wish to stop receiving such communications, you may send an email to www.rarohomes.in. You may also be contacted by service providers or third parties through SMS or calls, with whom we have entered into a contract in furtherance of our rights, duties, and obligations under this document and all other policies followed by us. Such contact will be made only in pursuance of such objectives, and no other calls will be made. The sharing of the information provided by you will be governed by the Privacy Policy, and we will not give out such contact information of yours to third parties not connected with the Website.

4. PLATFORM FOR TRANSACTION AND COMMUNICATION

The Website/Application serves as a platform for users to meet and interact with each other for their transactions. RARO Homes is not and cannot be a party to or control in any manner any transaction between the Website’s users. Users can browse through the variety of products available for sale/export. Transactions between RARO Homes and the users shall be kept confidential.

5. DISPUTE RESOLUTION

The formation, interpretation, and performance of this Agreement, as well as any disputes arising out of it, shall be governed by the laws, rules, and regulations of India. The exclusive jurisdiction and venue for actions and disputes mentioned above shall be the Courts located at Jammu, and you hereby submit to the jurisdiction of such Courts.

6. COVENANTS

• All commercial/contractual terms are offered by and agreed upon between you and RARO Homes. These terms include, without limitation, price, shipping costs, payment methods, payment terms, date, period, and mode of delivery, warranties related to products and services, and after-sales services related to products and services.
• RARO Homes assures food-safe products (applicable only in the food-safe section and not to other products where food (solid/liquid) consumption via the said products is prohibited) and further provides product liability insurance for the home products sold by RARO Homes.
• The Website/Application is a platform utilized by users to reach a larger base for buying and selling products or services. RARO Homes is only providing a platform for selling the products traded by EyeQ Business Solutions.
• RARO Homes is not responsible for delays resulting from products that are out of stock, unavailable, or back-ordered.
• You shall agree upon the manner and terms and conditions of delivery, payment, insurance, etc.

Disclaimer: Pricing on any product(s) as reflected on the Website/Application may, due to some technical issue, typographical error, or incorrectly published product information, be inaccurately displayed. In such an event, RARO Homes may cancel such order(s).

• You release and indemnify RARO Homes and/or any of its officers and representatives from any cost, damage, liability, or other consequence of any actions of the users of the Website, and specifically waive any claims that you may have in this regard under any applicable law.
• Refunds shall be made through the original payment mode. Once we receive the refund request, we shall process the refund within 7 business days. We reserve the right to block the user if false orders are made.

7. MEMBERSHIP CHARGES

Membership on the Website is free for buyers. RARO Homes does not charge any fee for browsing on the Website, however, RARO Homes reserves the right to change its fee policy from time to time. In particular, RARO Homes may, at its sole discretion, introduce new products/services and modify some or all of the existing products/services offered on the Website. Changes to the fee policy shall be posted on the Website, and such changes shall automatically become effective immediately after they are posted on the Website. Unless otherwise stated, all fees shall be quoted in Indian Rupees.

8. USER OBLIGATIONS

As a limited access user of this website, you are restricted from cutting, copying, distributing, modifying, recreating, reverse engineering, disseminating, posting, publishing, or creating derivative works from, transferring, or selling any information or software obtained from the website/Application. Limited use may be allowed with our prior permission. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes, and unwarranted modification of data and information within the content of the Website/Application is not permitted.

8.1   You agree not to access (or attempt to access) the Website and/or the materials or services by any means other than through the interface provided by the Website. m) Violate the Terms of Use including but not limited to any applicable additional terms of the Website contained herein or elsewhere;
n) Create liability for us or cause us to lose (in whole or in part) the services of our internet service provider (“ISP’s”) or other suppliers;
o) Multiple accounts are not allowed on the application. Result of such activity is all irrevocable account suspension.
p) Our payment methods can be changed anytime without any notification

You shall not engage in advertising to, or solicitation of, other users of the Website to buy or sell any products or services, including, but not limited to, products or services related to that being displayed on the Website or related to us. You may not transmit any chain letters or unsolicited commercial or junk email to other users via the Website. You hereby represent and warrant that you have all necessary rights in the Content which you provide and all information it contains and that such Content shall not infringe any proprietary or other rights of third parties or contain any libelous, tortuous, or otherwise unlawful information.

9. Contents Posted on Site

RARO Homes is liable only for the contents posted by it on the Website and holds no responsibility for any other content posted by any user or third party. Content(s) if posted by anyone other than RARO Homes, that party shall solely be liable for such content(s).

Except as expressly provided in these Terms of Use, no part of the Website and no Content may be copied, reproduced, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted or distributed in any way (including “mirroring”) to any other computer, server, Website or other medium for publication or distribution or for any commercial enterprise, without RARO Homes’s express prior written consent.

You may use information on the products and services purposely made available on the Website for downloading, provided that you (1) do not remove any proprietary notice language in all copies of such documents, (2) use such information only for your personal, non-commercial informational purpose and do not copy or post such information on any networked computer or broadcast it in any media, (3) make no modifications to any such information, and (4) do not make any additional representations or warranties relating to such documents.

We may share personal information with our other corporate entities and affiliates. These entities and affiliates may market to you as a result of such sharing unless you explicitly opt-out.

This disclosure may be required for us to provide you access to our services, to comply with our legal obligations, to enforce our user Agreement, to facilitate our marketing and advertising activities, or to prevent, detect, mitigate, and investigate fraudulent or illegal activities related to our services. RARO Homes does not warrant that this site; information, Content, materials, product (including software) or services included on or otherwise made available to you through the Website; their servers; or electronic communication sent from us are free of viruses or other harmful components.

Nothing on Website constitutes, or is meant to constitute, advice of any kind. All the products sold on Website are governed by different state laws and if the seller is unable to deliver such products due to implications of different state laws, the seller will return or will give credit for the amount (if any) received in advance by the seller from the sale of such product that could not be delivered to you.

You will be required to enter a valid phone number while placing an order on the Website. By registering your phone number with us, you consent to be contacted by us via phone calls and/or SMS notifications, in case of any order or shipment or delivery related updates.

12. Payment

While availing any of the payment method/s available on the Website, we will not be responsible or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to you due to:

1. Lack of authorization for any transaction/s, or
2. Exceeding the preset limit mutually agreed by you and between “Bank/s”, or
3. Any payment issues arising out of the transaction, or
4. Decline of transaction for any other reason/s

All payments made against the purchases/services on Website by you shall be compulsorily in Indian Rupees acceptable in the Republic of India. Website will not facilitate transaction with respect to any other form of currency with respect to the purchases made on Website.

Before shipping/delivering your order to you, we may request you to provide supporting documents (including but not limited to Govt. issued ID and address proof) to establish the ownership of the payment instrument used by you for your purchase. This is done in the interest of providing a safe online shopping environment to our users.

Transactions, Transaction Price and all commercial terms such as Delivery, Dispatch of products and/or services are as per principal to principal bipartite contractual obligations between buyer and seller(RARO Homes) and payment facility is merely used by the Buyer and Seller to facilitate the completion of the Transaction. Use of the different(which is not listed OR shown on the website) payment facility shall not render RARO Homes liable or responsible for the non-delivery, non-receipt, non-payment, damage, breach of representations and warranties, non-provision of after sales or warranty services or fraud as regards the products and /or services listed on the Website.
2. You have specifically authorized RARO Homes to collect, process, facilitate and remit payments and/or the Transaction Price electronically or through Cash on Delivery to and from other users in respect of transactions through the Payment Facility.
3. You understand, accept and agree that the payment facility provided by RARO Homes is neither a banking nor financial service but is merely a facilitator providing an electronic, automated online electronic payment, receiving payment through Cash On Delivery, collection and remittance facility for the Transactions on the RARO Homes Website using the existing authorized banking infrastructure and credit card payment gateway networks. Further, by providing payment facility, RARO Homes is neither acting as trustees nor acting in a fiduciary capacity with respect to the Transaction or the Transaction Price.

Payment Facility for Buyers:

• You, as a buyer, understand that upon initiating a Transaction you are entering into a legally binding and enforceable contract with the seller to purchase the products and /or services from the seller using the payment facility, and you shall pay the Transaction Price through your Issuing bank to the seller using payment facility.
• You, as a Buyer, may agree with the Seller through electronic communication and electronic records and using the automated features as may be provided by payment facility on any extension / increase in the dispatch and/or delivery time and the Transaction shall stand amended to such extent. Any such extension / increase of dispatch/delivery time or subsequent novation/variation of the Transaction should be in compliance with the Rules and Policies.
• You, as a Buyer, shall electronically notify payment facility using the appropriate RARO Homes’s Website features immediately upon Delivery or non-delivery within the time period as provided in Policies. In case of Cash On Delivery transactions, buyer is not required to confirm the receipt of products or services.
• Except for Cash On Delivery transaction, refund, if any, shall be made at the same issuing bank from where Transaction Price was received.
• For Cash On Delivery transactions, refunds, if any, will be made via demand draft in favour of the buyer (as per registration details provided by the Buyer)
• Refund shall be made in Indian Rupees only and shall be equivalent to the Transaction Price received in Indian Rupees.
• For electronics payments, refund shall be made through payment facility using NEFT / RTGS or any other online banking / electronic funds transfer system approved by Reserve Bank India (RBI).

1. RARO Homes reserves the right to impose limits on the number of Transactions or Transaction Price which it may receive from on an individual valid Credit/Debit/ Cash Card / Valid Bank Account/ and such other infrastructure or any other financial instrument directly or indirectly through payment aggregator or through any such facility authorized by Reserve Bank of India to provide enabling support facility for collection and remittance of payment or by an individual buyer during any time period, and reserves the right to refuse to process transactions exceeding such limit.
2. RARO Homes reserves the right to refuse to process Transactions by buyers with a prior history of questionable charges including without limitation breach of any agreements with RARO Homes or breach/violation of any law or any charges imposed by issuing bank or breach of any policy.
3. RARO Homes may do such checks as it deems fit before approving the receipt of/Buyers commitment to pay (for Cash On Delivery transactions) Transaction Price from the buyer for security or other reasons at the discretion of RARO Homes. As a result of such check if RARO Homes is not satisfied with the credibility of the buyer or genuineness of the Transaction / Transaction Price, it will have the right to reject the receipt of / buyers commitment to pay Transaction Price.
4. RARO Homes may delay notifying the payment confirmation i.e. informing seller to dispatch, if RARO Homes deems suspicious or for buyers conducting high transaction volumes to ensure safety of the Transaction and Transaction Price. In addition, RARO Homes may hold Transaction Price and may not inform seller to dispatch or remit Transaction Price to law enforcement officials (instead of refunding the same to Buyer) at the request of law enforcement officials or in the event the Buyer is engaged in any form of illegal activity.
5. The buyer and seller acknowledge that RARO Homes will not be liable for any damages, interests or claims etc. resulting from not processing a Transaction/Transaction Price or any delay in processing a Transaction/Transaction Price which is beyond control of RARO Homes.

 

13. Compliance with Laws

Buyer and seller shall comply with all the applicable laws (including without limitation Foreign Exchange Management Act, 1999 and the rules made and notifications issued there under and the Exchange Control Manual as may be issued by Reserve Bank of India from time to time, Customs Act, Information and Technology Act, 2000 as amended by the Information Technology (Amendment) Act 2008, Prevention of Money Laundering Act, 2002 and the rules made there under, Foreign Contribution Regulation Act, 1976 and the rules made there under, Income Tax Act, 1961 and the rules made there under, Export Import Policy of government of India).

14. DATA PROVIDED BY US

14.1 From time to time, our team may post comments or articles. These articles are the Intellectual Property of the Company and you are prohibited from posting, re producing, publishing, changing, editing such articles. In case that you have a problem with any article so posted, you may report the same via mail and we will look into it. We are under no obligation to remove such articles and the final decision lies with us.

14.2 We take utmost care to ensure that data provided at our Website is true and accurate. Sometimes, system errors creep in and data generated by other users may be false. We are not responsible for any such data.

14.3 We are not in any way liable to you, for any loss arising to you from activities that include but are not limited to our negligence, breach of contract, Intellectual Property and Trademark infringement, breach of laws, etc.

All material on this site, including images, illustrations, audio clips, and video clips, is protected by copyrights, trademarks, and other intellectual property rights. Material on the Website is solely for your personal, non-commercial use. You must not copy, reproduce, republish, upload, post, transmit or distribute such material in any way, including by email or other electronic means and whether directly or indirectly and you must not assist any other person to do so. Without the prior written consent of the owner, modification of the materials, use of the materials on any other website or networked computer environment or use of the materials for any purpose other than personal, non-commercial use is a violation of the copyrights, trademarks and other proprietary rights, and is prohibited. Any use for which you receive any remuneration, whether in money or otherwise, is a commercial use for the purposes of this clause.

16. INDEMNITY

You agree to defend, indemnify, and hold harmless RARO HOMES, its officers, subsidiaries, affiliates, successors, assigns, directors, officers, agents, service providers, suppliers, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt and expenses arising from:

(i) Your use of and access to the website and/or the service;

(ii) Your violation of any term of these Terms; or

(iii) Your violation of any third party right, including without limitation any copyright, trademark, trade secret, or other property, or privacy right; or

(iv) Any claim that your content caused damage to a third party;

This defence and indemnification obligation shall survive termination, modification or expiration of these Terms and your use of the service and the website.

17. TERMINATION AND LIMITATION OF SERVICE

18. FORCE MAJEURE

In the event of a force majeure act or upon the outbreak of certain natural and/or man-made calamity such as earthquake, war, riots, epidemics, pandemic etc. the parties may be absolved of their responsibilities as warranted under these terms at the instance of RARO Homes. Should the force majeure event permanently absolve a party of any of its responsibilities under these terms, the accounts and dues shall be settled.
